Terms of service
Last updated 25 October 2026. Version française.
These terms are an agreement between you and Bay Three Software Inc. ("Libreyard", "we", "us"), of 11 Kensington St, Guelph, Ontario N1E 3P3, Canada. You agree to them when you create your account. The privacy policy and the refund policy are part of them.
They are written to be read. If you use Libreyard as a consumer, the consumer protection law of the place where you live gives you rights that these terms do not take away. Where a sentence here says "to the extent the law allows", that is what it means.
1. The service
For each vault you create, we run a dedicated instance of the Vaultwarden server at an address under libreyard.app, and a portal where you manage your vaults and their subscriptions. Vaultwarden and the Bitwarden apps are other people's software, provided under their own licences; see open source and upstream. What a vault includes is on the pricing page.
We improve and change the service over time. If we take away something the pricing page says a vault includes, we tell you by email at least 30 days before, and you can cancel and receive a refund of the unused part of your year.
2. Your account
- You must be at least 18, or the age of majority where you live if that is higher, and able to enter into a contract.
- Give us an email address that is yours and that you read. Everything about your account and your subscriptions is sent to it.
- Keep your portal password, your authenticator and your recovery codes safe. What is done with them is treated as done by you. Tell us at once if you think someone else has them.
- You own each of your vaults. You decide who is invited, and you are responsible for what the people you invite do with it. They are not a party to these terms; you are.
- An account can hold several vaults, up to the number the portal allows. Each has its own subscription.
3. Price, payment and renewal
- Each vault costs $29 USD a year, paid in advance by card through our payment provider, Stripe.
- Sales taxes are added where we are required to collect them, such as GST/HST in Canada or VAT elsewhere. Checkout shows them, and the total, before you pay. Your card issuer may charge a fee for paying in USD.
- A subscription renews automatically each year, at the price then in force, until you cancel. You get a reminder by email before each renewal. You can cancel at any time in the portal, without writing to anyone.
- If a payment fails, Stripe tries again over the following days and we email you each time. If it still fails, the subscription ends.
- If we change the price, we tell you by email at least 30 days before your next renewal. The new price applies from that renewal on, and you can cancel before it.
- Refunds follow the refund policy.
The free trial
- One vault per account can start with a free trial of 30 days instead of a payment. No card is needed to start it.
- We email you three days before the trial ends. If you have added a card by then, the first year is charged to it on the day the trial ends, and the subscription continues as above.
- If you choose to pay before the trial ends, you are charged at once, the paid year starts that day, and the rest of the trial is given up.
- Without a card, the subscription ends with the trial and nothing is charged. The vault's data is then treated as in section 8.
4. Your data
- What you store in your vaults is yours. You give us only the permission we need to store it, copy it into backups, move it between our servers and give it back to you, for as long as we run your vaults and keep the backups.
- Vault contents are encrypted on your devices. We cannot read them, and we cannot recover a master password. The security and privacy page says what we can and cannot see, and the privacy policy what we do with personal data.
- We look at a vault's files only when running, repairing or securing the service requires it, when you ask us to, or when the law requires it.
- You can download a complete copy of a vault's data from the portal at any time while your account exists, including during the 30 days after a subscription ends.
- We back up every vault to recover from our own failures, and restore a vault from a backup when you ask. We do not promise that a backup exists for a given moment. Keep your own copy: leaving says how.
5. Acceptable use
A vault is for storing and sharing passwords and similar secrets among people you know. You agree not to:
- use the service to break the law, to infringe anyone's rights, or to store or share material that is unlawful;
- use it to attack, probe, scan or overload Libreyard, other customers or anyone else;
- try to get out of your vault's sandbox, or into anyone else's data;
- resell the service, or run a vault as a public service for strangers;
- use a vault as general file storage.
Each vault has a storage limit: 1 GB, or 100 MB during the free trial. It counts everything in the vault's data directory. At the limit, saving new items or files fails, and nothing already stored is lost.
6. Availability and support
We work to keep the service running, and we do not promise that it always will. There is no uptime guarantee and no service credit. One person operates the service. The Bitwarden apps keep an offline copy of each vault for this reason, and you should keep your own copy as well.
We update Vaultwarden and maintain our servers, which sometimes interrupts the service briefly. Compatibility depends on software we do not control: a new release of a Bitwarden app can stop working with Vaultwarden until Vaultwarden catches up.
Support is by email at support@baythreesoftware.ca. We answer within two business days.
7. Warranty and liability
The service is provided as it is and as it is available. To the extent the law allows, we give no warranty, express or implied, that it will be uninterrupted, free of errors, or fit for a particular purpose. Where the law does not allow a warranty to be excluded, it applies only as far as the law requires.
To the extent the law allows:
- we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or goodwill, arising from the service or these terms, even if we were told they were possible;
- we are not liable for a loss you could have prevented by keeping your own copy of your data, as section 4 asks;
- our total liability to you, for all claims together, is limited to what you paid us in the 12 months before the event that gave rise to the claim.
Nothing in these terms limits our liability for fraud, wilful misconduct or gross negligence, or for anything else the law does not allow to be limited, and nothing takes away your rights as a consumer.
If someone makes a claim against us because you, or someone you invited, used the service in breach of section 5, you are responsible for that claim, to the extent the law allows.
8. Ending the agreement
By you
You can cancel a subscription at any time in the portal. It then ends at the end of the year you paid for, or of the free trial, and you can undo the cancellation until then. You can also stop or delete a vault, or close your account, at once. None of these refunds anything by itself; the refund policy says when you can ask for a refund.
By us
We may suspend or end a vault, or your account, if you do not pay or if you break section 5. Unless the law, an emergency or a risk of serious harm to others prevents it, we tell you first and give you the chance to put it right. If we end a subscription for any other reason, we give you at least 60 days' notice and refund the unused part of your year.
What happens to the data
When a subscription ends, for any reason, the vault is stopped and its data is kept for 30 days. During that time you can download it or subscribe again. Then it is deleted, and we confirm the deletion by email. If you delete a vault or close your account yourself, deletion is immediate. Copies in our backups expire as the privacy policy says.
9. If Libreyard closes
If we decide to stop offering the service, we tell you by email at least 60 days before, keep the data download working until the end, and refund the unused part of your year. If the service stops for reasons outside our control, we may not be able to give that notice. If Libreyard disappears describes what you hold in that case.
10. Changes to these terms
We may change these terms. For a change that matters, we tell you by email at least 30 days before it takes effect, and the date at the top of this page changes. If you do not accept the change, you can cancel before it takes effect and receive a refund of the unused part of your year. Otherwise the new terms apply from that date.
11. Law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you have a problem, write to us first: most problems are solved that way. A dispute that is not goes to the courts of Ontario. If you are a consumer, you also keep the protection of the mandatory law of the place where you live, and the right to bring a claim in its courts where that law gives you one.
12. General
- These terms, the privacy policy and the refund policy are the whole agreement between you and us about the service.
- If a part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a part of these terms at some time, we can still enforce it later.
- We are not responsible for failures caused by events beyond our reasonable control, such as a failure of our hosting provider, of the internet or of the power supply.
- We may transfer this agreement to a company that takes over the service, and tell you by email when we do. You may not transfer it without our agreement.
- We send notices to the email address of your account. You can send them to the address below. When a vault starts, we email you a copy of the agreement for it.
- These terms and the two policies exist in English and in French, and both versions are equally valid. The portal and the rest of the site are in English.
